Terms of Service

1. Contracting entity

Unless a signed agreement says otherwise, Montaigne is the entity that receives enquiries, runs GTM and strategy work, operates advertising and lead-generation flows, signs partner or product agreements, invoices clients or partners, and coordinates delivery through its operating lines. This includes HNWI Chronicles product engagements and Siya Prive partner or property-demand arrangements.

3. HNWI Chronicles terms

HNWI Chronicles outputs may include research, decision memos, briefings, pattern reviews, dashboards, or other decision-intelligence products. These outputs are for informational and decision-support purposes only. They are not legal advice, tax advice, investment advice, banking advice, trustee advice, valuation advice, regulated wealth management, or a substitute for advice from licensed professionals.

Clients and users remain responsible for obtaining legal, tax, investment, banking, property, regulatory, accounting, and other professional advice before acting on any decision. HNWI Chronicles may help identify questions, risks, contradictions, and decision burdens; it does not make regulated decisions for a client.

4. Siya Prive terms

Siya Prive may support property-related GTM, lead qualification, buyer routing, property discovery, visit coordination, communication, partner reporting, and transaction-stage support. Unless a signed agreement expressly states otherwise, Montaigne and Siya Prive are not the property developer, property owner, title issuer, lender, statutory approval authority, or final source of price, availability, title, RERA, or compliance representations.

Buyers, partners, and counterparties must verify property details, approvals, title, possession status, taxes, charges, financing, and transaction terms with the relevant developer, owner, authorised broker, or professional adviser. Montaigne may receive fees, retainers, referral payments, success fees, revenue share, or other commercial consideration from partner or property workflows where permitted by the relevant agreement.

5. Partner and product agreements

Partner agreements, HNWI product agreements, Siya Prive arrangements, proposals, order forms, NDAs, and statements of work may contain specific scope, confidentiality, payment, delivery, termination, commercial, and liability terms. Those signed terms control the relationship for that engagement. Website text, ads, and landing pages do not replace signed agreements.

6. Enquiries and lead forms

Submitting a form, responding to an ad, sending a WhatsApp message, booking a call, or emailing us does not create a client relationship, advisory relationship, exclusivity, partnership, or obligation to accept work. We may decline, hold, route, or qualify enquiries based on fit, capacity, commercial context, legal risk, partner constraints, or operational readiness.

7. Confidentiality

Do not send confidential, sensitive family, financial, legal, property, transaction, or strategy material through open web forms unless we have agreed on an appropriate channel. Confidentiality obligations apply only as stated in a signed NDA, agreement, or written communication from Montaigne.

8. Payments and commercial terms

Fees, retainers, product prices, delivery timelines, refunds, payment milestones, success-fee structures, and partner commercial terms apply only as stated in the relevant proposal, invoice, product agreement, partner agreement, or written commercial confirmation. Taxes and third-party charges may apply.

9. Intellectual property

The Montaigne website, HNWI Chronicles materials, Siya Prive materials, research formats, memos, frameworks, dashboards, designs, brand assets, writing, code, and system architecture are owned by Montaigne or licensed to Montaigne unless otherwise stated. You may not copy, reproduce, publish, resell, scrape, or create derivative works from these materials without written permission.

10. Third-party platforms and links

We may use or link to third-party platforms such as Calendly, Meta, Google, WhatsApp, LinkedIn, payment providers, property partners, developer pages, analytics providers, and hosting providers. Their services are governed by their own terms and policies. We are not responsible for third-party sites or systems outside our control.

11. No guarantee

We do not guarantee investment outcomes, property outcomes, sale outcomes, site visits, financing approval, regulatory outcomes, tax outcomes, family decisions, partner acceptance, lead quality, conversion rate, or commercial result unless a signed agreement expressly says otherwise. Any examples, metrics, case references, or system descriptions are context, not a promise of future performance.

12. Limitation

To the maximum extent permitted by applicable law, Montaigne is not liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from website use, ad interaction, third-party reliance, partner action, or decisions made without independent professional advice. Any engagement-specific liability terms will be governed by the signed agreement for that engagement.

13. Privacy

Personal information is handled according to the Montaigne Privacy Policy. The privacy policy covers Montaigne, HNWI Chronicles, Siya Prive, advertising, lead generation, partner routing, and product-delivery workflows.

14. Governing terms

These website terms are governed by Indian law unless a signed agreement states otherwise. If any part of these terms is unenforceable, the remaining parts continue to apply.
